1. Acceptance of Terms

By accessing or using NexusMind AI ("the Platform", "the Service"), you ("the User", "the Clinician") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Aussi-Nexus Group, a sole-trader business registered in Queensland, Australia (ABN 76 947 108 181), operated by Dr Manas Swain.

2. Eligibility — Licensed Clinicians Only

Access to NexusMind AI is restricted to:

• Medical practitioners registered with the Australian Health Practitioner Regulation Agency (AHPRA) or an equivalent international regulatory body
• Qualified healthcare professionals acting within their scope of practice
• Medical researchers and educators using the Platform for professional purposes

By registering, you represent and warrant that you are a licensed medical professional. Misrepresentation of professional status is grounds for immediate account termination and may constitute fraud.

3. Nature of the Service — Clinical Decision Support Only

NexusMind AI provides AI-generated differential diagnosis suggestions based on clinician-entered symptom data. The Platform:

• Is a decision support tool only and does not constitute a definitive medical diagnosis
• Does not replace clinical examination, patient history-taking, or professional judgment
• Does not have access to actual patient medical records
• May produce outputs that are incomplete, inaccurate, or inapplicable to individual patients
• Is not a substitute for specialist referral where clinically indicated

All diagnostic and treatment decisions remain the sole clinical and legal responsibility of the treating medical practitioner.

4. Subscription and Payment

The Pro Clinician subscription is priced at AUD $39.99 per calendar month. New accounts include 3 free analyses with no payment required. Subscriptions are billed monthly via Stripe. You may cancel at any time via the billing portal; cancellation takes effect at the end of the current billing period. Aussi-Nexus Group reserves the right to modify pricing with 30 days' written notice.

5. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law and applicable legislation, Aussi-Nexus Group, its owner, employees, and agents shall not be liable for:

• Any clinical outcome arising from reliance on Platform outputs
• Misdiagnosis, delayed diagnosis, or harm resulting from AI-generated suggestions
• Any direct, indirect, incidental, consequential, or special damages
• Loss of income, data, or professional reputation

Our total aggregate liability to you shall not exceed the amount paid by you in the 3 months preceding any claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Aussi-Nexus Group and its owner from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from: your use of the Platform; your violation of these Terms; your clinical decisions; or any claim by a third party (including patients) arising from your use of Platform outputs.

7. Intellectual Property

All content, algorithms, designs, and software comprising NexusMind AI are the intellectual property of Aussi-Nexus Group. You may not copy, reverse-engineer, redistribute, or commercially exploit any part of the Platform without written consent.

8. Data and Privacy

Do not enter personally identifiable patient information into the Platform. Use anonymised patient references only. See our Privacy Policy for full details on data handling.

9. Termination

We may suspend or terminate your account immediately for breach of these Terms, fraudulent use, or misrepresentation of professional status. You may terminate your account at any time.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of Queensland courts.

We collect: name, email address, medical specialty, AHPRA number (optional), payment information (via Stripe — we never store card details), and anonymised symptom data you enter for diagnostic analysis.

2. How We Use Your Information

Your data is used to: provide the diagnosis support service; process payments; send service communications; improve AI model accuracy (using anonymised data only); and comply with legal obligations.

3. Patient Data — Critical Notice

You must not enter personally identifiable patient information into NexusMind AI. The Platform is designed for anonymised clinical data only. You as the clinician are responsible for compliance with your obligations under the Privacy Act 1988, the My Health Records Act 2012, and all applicable patient confidentiality legislation.

4. Data Storage and Security

Data is stored on secure servers in Australia (Hetzner infrastructure). We use industry-standard encryption (TLS 1.3), hashed passwords (bcrypt), and JWT authentication. We do not sell your data to third parties.

5. Data Retention

Account data is retained for the duration of your subscription plus 7 years (for legal compliance). You may request deletion of your data by contacting [email protected].

You have the right to: access your personal information; correct inaccurate information; request deletion; and make a complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

1. Not a Medical Device

NexusMind AI is a clinical decision support software tool. It has not been evaluated or approved by the Therapeutic Goods Administration (TGA) of Australia as a medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition.

2. AI Limitations

The AI models powering NexusMind AI have inherent limitations including but not limited to:

• Training data bias and knowledge cutoffs
• Inability to physically examine patients
• Inability to access real-time laboratory or imaging results (unless entered manually)
• Potential for hallucination or generation of plausible but incorrect clinical information
• Inability to account for all individual patient variables
• Performance may vary across different patient populations and clinical contexts

3. Clinician Responsibility

All diagnostic and treatment decisions are the sole responsibility of the treating clinician. NexusMind AI outputs must be:

• Critically evaluated by a qualified medical professional
• Verified against current clinical guidelines and evidence
• Considered alongside full clinical assessment, examination findings, and investigations
• Never acted upon without independent clinical judgment

4. Emergency Situations

NexusMind AI is not designed for use in acute emergency situations. In any medical emergency, follow standard emergency protocols, contact emergency services, and do not rely on AI-generated outputs for immediate clinical decisions.

5. No Doctor-Patient Relationship

Use of NexusMind AI does not create a doctor-patient relationship between Aussi-Nexus Group, its owner, or the AI systems and any patient whose data is entered. Aussi-Nexus Group is not a registered healthcare provider.

6. Regulatory Compliance

Clinicians remain responsible for compliance with all relevant professional standards, AHPRA obligations, and applicable legislation including the Health Practitioner Regulation National Law. Use of AI decision support tools must be consistent with your registration standards and professional obligations.
